Notice is hereby given that the Zoning Hearing Board of South Whitehall Township will conduct a Public Hearing on Wednesday, December 28, 2022, at 7:00 P.M., in the South Whitehall Township Municipal Building located at 4444 Walbert Ave, Allentown, Lehigh County, Pennsylvania, for the following zoning appeal:
ZHB-2022-11: The Appeal of Shia Ithna Asheri Jamaat of PA, seeking a Favorable Interpretation of Section 350-42(h)(2)(B) Height Exemptions, that “when attached to the roof of an existing or proposed Building, and not otherwise permitted as an Accessory Use, the height of the Building(s), Structure(s), or portions(s), thereof shall not exceed one hundred forty (140%) percent of the height of the Principal Building.” The Applicant seeks to find a Favorable Interpretation to allow the minarets to qualify for a total height of up to 120 feet; and in the alternative, a Variance to allow that height of the minarets up to 120 feet. The subject property is located at 1500 Ridgeview Drive and is zoned R3 Low Density Residential District whereas Section 350-24(c)(5) Low Density Residential allows for a maximum building height of fifty (50’) feet. ZHB-2022-12: The Appeal of Florin C. Nutas & Christian Badelita, seeking a Favorable Interpretation to construct a Single-Family Dwelling on a lawful nonconforming lot utilizing setback criteria from a previously approved land development plan known as Minor Subdivision Plan Francis J. & Ann L. Micklus prepared by Martin H. Schuler Co. dated January 18, 1980, last revised June 9, 1980; or in the alternative, dimensional variance relief from Section 350-24(c)(2) RR-2 Rural Residential District from requiring 75 feet front and rear yard setbacks where 50 feet is proposed. Copies of any plans, applications, and/or supporting documents that were submitted can be available for public inspection at the Township Building during normal business hours where they may be examined without charge or obtained for a charge not greater than the cost thereof (it is recommended that appointments be made in advance).
