Zoning Hearing Board March 27, 2019

Notice is hereby given that the Zoning Hearing Board of South Whitehall Township will conduct a public hearing on WEDNESDAY, MARCH 27, 2019, at 7:30 p.m., in the South Whitehall Township Municipal Building located at 4444 Walbert Ave, Allentown, Lehigh County, Pennsylvania, for the following zoning appeals:

ZHB-2019-01:  A continued public hearing on the amended Appeal of Allentown (Walbert) DG, LLC, f/k/a Allentown (Walbert Avenue) DG, LLC, requesting the modification of a condition of approval imposed at Zoning Appeal Docket No. ZHB-2018-03 in order to permit the Applicant to install five (5) freestanding light poles, instead of two (2) freestanding light poles, for its reconfigured parking lot which Applicant asserts is required to effect compliance with the parking lot illumination standards of the Zoning Ordinance, and further seeking additional, modified, or a reaffirmation of, variance relief from the buffer strip width requirement of Section 350-42(b)(1) and the rear yard parking lot setback requirements of Sections 350-48(o)(2)(E)(iv)(a) and (c) of the Zoning Ordinance for Applicant’s reconfigured parking lot.  Zoning relief is sought as a result of plan revisions requested by the Pennsylvania Department of Transportation (“PennDOT”) in its review of Applicant’s application for a Highway Occupancy Permit for its proposed driveway.  Plan revisions requested by PennDOT include modifications to the proposed driveway which Applicant asserts have necessitated a reconfiguration of the on-site parking lot area.  The property is located at 2032 and 2070 Walbert Avenue.  Tax I.D. Parcel Nos. 549705045134 and 549705249213.  The property is zoned Neighborhood Commercial (NC).

ZHB-2019-03:  The appeal of Jordan United Church of Christ seeking relief to be able to replace an existing sign that will include an electronic graphic display component, on the property located at 1837 Church Road. The appellant is seeking a Special Exception review approval per Section 350.41(d) and a dimensional variance to Section 350-48(s)(10)(E)(x)(c)(7) pertaining to the minimum distance required between a sign having an electronic graphic display component and an intersection. The subject property is zoned “RR”, Rural Residential and Agricultural.

ZHB-2019-04:  The appeal of Willow222, LLC operators of Hamilton Animal Care seeking relief to be able to install and maintain a freestanding sign that will include an electronic graphic display (EGD) component, on the property located at 4570 W. Tilghman Street. The appellant is seeking a favorable interpretation or in the alternate a variance, that the project is not a Coordinated Development subject to Section 350-48(s)(10)(E)(xii)(i)(1) that requires a minimum lot size of more than 10 acres for an EGD Sign. Depending on the project classification, a dimensional variance is sought to either Section 350-48(s)(10)(E)(x)(c)(7) or 350-48(s)(10)(E)(xii)(i)(8) pertaining to the minimum distance required between a sign having an EGD component and an intersection. The subject property is zoned HC-1 Highway Commercial-Special Height Limitation.

The above-referenced properties are in South Whitehall Township, Lehigh County, PA. Copies of any plans, applications, and/or supporting documents that were submitted can be available for public inspection at the Township Building during normal business hours where they may be examined without charge or obtained for a charge not greater than the cost thereof (it is recommended that appointments be made in advance).  All appellants, or their representative with legal standing, must attend.  All objectors and interested parties are invited to attend and will have the opportunity to be heard.
